Abstract
Alexandre Kojève appropriated the Weberian heuristics of pure types both in his Outline of a Phenomenology of Right and in The Notion of Authority. However, in the latter, he put forth a critique of Weber’s sociological categories to query their essence, and what becomes of legitimacy when it vanishes from the phenomenal world. This chapter explores the silence of legitimacy in the indeterminateness of international law as a vanishing mediator between the political exception and the legal norm.
