Transgender offenders within the prison estate: a comparative analysis of penal policy

    Abstract

    This chapter undertakes a comparative analysis of penal policies relating to transgender offenders in Australia, Canada, England and Wales, and the United States of America addressing the following key areas. Firstly, it considers theoretical perspectives, transgenderism and imprisonment. Secondly, legislation and the application of penal polices to the placement transgender prisoners in the above territories are compared. Thirdly, notions of 'legitimate‘ victimhood and the transgender prisoner are discussed. Finally, the practical implications of facilitating gender equality and gender symmetry in prisons are outlined. Overall, this chapter illustrates how the accommodation of trans people in the prison estate raises questions regarding taken-for-granted aspects of penal policy based on the socially prescribed gender binary.
